Payday Loans

WARNING

As recently qualified teacher, cash has been tight and therfore have a second income. I recently took out a small payday loan with WONGA. After recieving notification that i could defferer, i chose to action this on the website. Several days later i checked my account and nothing had registered?
Upon calling Wonga and speaking to an advisor, who explianed that legally they cannoy action a defferment until a payment is made? she went on to applogise that the site does not not make this clear.

My payment was due on the 24th June 11 and i advised that funds were not available until 30th June 11, thae advisor suggested that i leave it until the evening of the 24th allowing the account to go into arrears and call to arrange a defferment.

Before doing this, i discovered to my horror that they had applied for the full payment on the 24th and that this had failed as i advised, however, they continued chipping away at my account over two days taking little amounts and emptied my account and took what they could. I have since had a partial refund as they admit liability for being wrongly advised.
The money in my account was living expenses and fuel money to take me to and from my second job. As a result i contacted my employer to advise i could not make the shifts due to finance. At present i have lost 4 shifts to the value of just under £300 a much needed source of income for now. Left in hardship over the weekend and the worry and stress.
I have launched a complaint with the Ombudsman and have requested leagl help. SO BE CAREFUL of Pay day laons. I cannot comment publicaly further on this now as i am awaiting a response from Wonga and my solicitor.

    What is the warning Ian?

    Read T&Cs before you sign up for something?

    From their website:


    If there's an unavoidable short term change in your circumstances, however, you may extend your loan for up to a month from the current promise date on a strictly limited basis. You can do this yourself by logging in to the MyAccount area of the site at least one day before repayment is due.
    Simply select the new date and you'll be shown exactly how much extra your repayment will be. Remember that extending a loan will always cost you more and should therefore be avoided if possible. An administration fee will be added to your balance and interest will continue to accrue (at the same rate as normal) during the extension period.
    Unlike some less scrupulous lenders, we also require a part-payment of the current balance to approve an extension. All interest and fees accrued to date must be repaid, leaving only the principal amount borrowed to be extended. This not only helps rebuild our faith in you, but also greatly reduces the outstanding balance on which interest will apply. So please only arrange an extension if you're happy with these terms and have the cash available to make a part-payment.

    It wasn't really though was it?

    That money was the money you promised (and signed a contract for) to give to Wonga at the end of your loan term.
    You simply decided you would rather spend that money on something else instead of meeting your obligation.

    The Warning is simply....

    DO NOT TAKE OUT A PAYDAY LOAN UNLESS YOU ARE SURE YOU CAN REPAY.

    Like the wonga site suggests:
    Unlike some lenders or credit card providers, we won’t keep rolling your existing balance endlessly or encourage you to make minimum repayments. So please think very carefully before you apply, because we expect you to repay us when you promise to. If you have any doubts over whether you'll be able to do that comfortably, please don’t apply in the first place.

    The warning is don't borrow what you can't afford to pay back.

    This person is going to be a teacher /me shakes my head till it almost falls off.

    why moan after the event,these forums are full of stories like this if you had took 5 minutes to read just one of them you might have read someone elses story with the same warning and listened.

    I have alot of symapthy for you. It is easy to moan and point out other people's misfortune but most people who take out payday loans are pretty desperate and aren't into reading the small print. I have signed contracts in the past I have regretted. I hope you find a way to resolve your difficult situation.

    No sympathy from me whatsoever.

    "Aren't into reading the small print" is the most pathetic excuse I have ever heard.

    It looks like the "difficult" situation has been resolved by the OP paying back what they borrowed. Not really "difficult" at all.

    To the OP, congratulations on qualifying, well done.
    Also kudos to you on taking a second job to try to make ends meet.

    Alas though all you have complained about is there in the terms and conditions, on the PDL website and all over the internet from people who feel hard done by and scammed.

    Do not waste good money on legal action, instead put it towards trying to break free from the PDL trap.
    Go without, sell stuff, trim your living standards do what you have to so that you can pay off Wonga and never touch them again with a barge pole.
