P45 Advice

Hello lovely forum members

My husband finally after nearly 2 months of nagging his old employer, received his P45 so he can pass it to the JC.

He is currently claiming ESA (appeal rate) whilst receiving treatment for his back. He is slowly but surely making improvements so with any luck will be back to work by the end of the year :j

Now the problem is his P45 is wrong. It has his correct NI number, name and address BUT has the wrong date of birth and leaving date.

Hubbie left on the 30th April. He started claiming ESA on the 1st of May. On his P45 it is saying he left on the 30th May.

Now, his old employers are known for doging wages and tax (when everyone should have gotten an extra £10 a month in their wages last year no-one got one ... suspect they pocketed it) and I have a strong feeling that they have claimed 1 extra month SSP for hubbie when he did not work there.

The JC said that becuase there is a discrepancy between his apparant leaving date and the date he started to claim, they would have to investigate.:eek:

What should we do? Call the old employer and get them to speak to the HMRC, amend the P45 and reissue it to hubbie? Let the JC investigate and sort it out with the old employer? Hubbie to call the HMRC direct and advise about the incorrect dates and details?

I am really really worried they have mucked up his tax and will appear that he has been lying. (He has evidence via bank statements, wage slips and docs notes to prove when he left etc etc) and that he will also be hit with a MASSIVE tax bill :(

Can anyone please point us on the best action to take

    Do the P45 pay and deductions amounts match with what was on his last payslip?

    No. It is almost £700 over what he earned

    In that case, ask them for evidence for the sums involved.

    And start compiling evidence that he was NOT paid that extra amount: bank statements, payslips etc.
