court again with cabot

i dont really know how to use these forums but here goes had credit card with the halifax fell behind couldnt afford to keep up payment. sarted paying a debt company then that changed to cabot had a standing order in place for few years never missed payment then saw somthing like this forum about asking the company if they do own the debt. so sent letter to them they susspended bank payments told me they were doing everything to get the details from Halifax heard nothing. last month taken to court by Morgan solicitors i showed up they did not so judge dissmissed case. hand delivered through letter box another citation obtained from another court but close to me for the same debt but def solicitors. can i just say that while i was paying i would still get up to 10/15 call a day from them threatining letters yet they were still taking their standing order i would send recorded letters asking for them to stop but to no avail please can anyone help thanks kate

Hi Kate, I'm not sure what would be the best thing to do, sounds like your debt has been passed from agency to agency. Have you tried to get any help resolving this from one of the debt help organisations? Do you still owe money on the account, or did you end up paying it all off?

You could contact CCCS (Consumer Credit Councelling Serice), they might be able to help? They help with debt management plans etc, but they could be a good point of contact to get some clarification on where you stand with this.

yes i still owe the debt i am disputing if cabot own it do you think that i should write to the Halifax

If they failed to turn up last time, you can point out to the judge that the company are using the courts as a bullying service and wasting both the courts and your time, ask for the judge to rule the actions as Vexatious and certainly if they fail to show again .

thanks as i said i have never missed payment i just question who owns it to date cabot have still not sent proof and they were the ones that susspened payment will i say that in court to with the letter from cabot say they are not taking any payments

If you were to get a recent copy of your credit file, would this show who owned the debt? I'm not sure if it displays who originally owned it or who owns it now in terms of DCA's.
