What Are My Rights

Hey,

About 4 months ago I stepped into a Nationwide to change my cash card (Purple) because it didn't have 3 digits on the back which I needed for some online transactions. The lady was new, very kind in her approach and offered me a new Debit card (Blue) which I refused and she offered me an overdraft which I immediately said no.

Two weeks later I received my card and whilst having no money in the bank I was waiting for £279 refund to clear after 7 days in which I withdrew the money on the 7th day online which went through fine.

A few days later I find that this company hasn't given me the refund and I've actually been going into an overdraft which I've never asked for inccuring all amounts of charges.

What are my legal rights? I specifically asked the women at the counter to refuse an overdraft on the card because I've come from a gambling background and have lost thousands in the past but have recentley cleaned my act up.

I've been shafted to the core.

    If you'd been going into an AUTHORISED overdraft, i.e. one that the lady put on, then you wouldn't have been incurring all amounts of charges, so this means that its an unauthorised overdraft. You should manage your money better, on that count.

    As far as being "shafted to the core" I think you are very much overreacting there. Legal rights? For what exactly? Are you another of these people trying to blame everything on someone else?
  • Maybe this is a silly question, but why didn't you check your balance before withdrawing the money ??

    If it's an authorised overdraft just clear the balance and cancel it. If it's an unauthorised one and they've charged you there's very little you can do as we all have a responsibility to ensure there is enough money in our accounts.
    If you've nothing decent to say, perhaps you shouldn't say anything.

    I agree with the previous posters.

    It would seem you 'shafted' yourself by not checking your balance before withdrawing your money.
