    the lender can apply for foreclosure (reposession order).


    Foreclosure is an American thing. repossession here.

    The house is already up for sale and my brother has reduced the price at my friends request for a quick sale. There is now no equity in the house so he wants to just walk away leaving my brother to deal with it.

    If the other bloke's moved out, your brother should get a lodger in to cover the other half of the mortgage while this is sorted out.

    He can get:
    - lodgers, they tend to not stay many months, just be open about the house being for sale
    - Mon-Fri lodgers, people working away from their main home that need a local base for their work (which might be short term contracts)

    Does your brother want to sell it? If not,then he needs to take it off the market!

    I presume they both jointly agreed to market it and both signed an EA contract?

    What exactly is this other person doing...apart from getting on with his life and leaving your bro to clear up after him?
    Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..
