Anyone know anything about defaults?

I read smewhere that if a default has been regsitered against you but that some aspect of it is incorrect yu can get it removed. Does anyone know if this is true? I'm working mega hard to clear up my file and found that the one creditor I have left who, to be honest was a right sh*t when I was trying to sort my problems out, has put an incorrect date of birth on my file. Any advice greatly apreciated

  • IT's not entirely straight forward and I haven't tackled it yet, but if you go to https://www.consumeractiongroup.co.uk and look at the forum, there is a section on legalities of defaults. This might help.
  • An incorrect date of birth would not necessarily invalidate a registered default.

    The main items to review are;

    1) was a default notice issued
    2) was the notice compliant with S.88 of the consumer credit act
    3) did you initially give consent to publish account / contract data


    these are main 3 requirements, however if you read the consumer action site there are many other threads on the subject
