I'm not sure when the company expects its' employees to see their families.

The same way that people who work in retail, hotels, restaurants, hospitals, nursing homes, distribution, or any other number of businesses see their familiies.

Although Sundays are in your contract, there is a chance an argument could be made under the Customs and Practice section of employment law, assuming you haven't actually worked a Sunday in a long time.

Sadly it is quite a vague law, and people interpret it in different ways, but its worth looking at.

Not really, I would say it is unlikely that OCADO would lose any tribunals by changing contracts for the staff to make them work sundays if it is fair (ie not just done to a small selection of staff) if they can show there was a genuine business need to do this.

Working sundays to bring more money in for the same cost of staffing (or a slight increase) is a genuine business need.
The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

I really can't see the problem here as you'll get the two weekend days off during the week.

I know people don't all have the weekend off, but usually those employees are employed knowing that their days off will be mid-week. The problem -scooby088- is having young children, taking them to birthday parties, dance classes, days out, family events etc. What good is Tuesday off to spend in the house all by yourself?

Considering Ocado warehouse employees already work on Saturdays and Ocado love to try and exude a family friendly persona; I think it wrong of them to expect their employees to work Sundays. By all means change it for new employees under new contracts.

Also religious grounds are not suitable, and you have to prove it. Employees have to prove they attend church, prove they have childcare commitments(single/separated).

Actually - the answer would be "yes" not "no" - because in post #3 the OP has stated that their contract says that they must work some Sundays.

Not really, because the question relates to Ocado changing the employment contract. Whether the contact is changing from no Sundays or some Sundays is neither here nor there.

im aware ocado have no shops but does that make a difference as they are still a business

Yes, because the 'special rules' for shop workers only apply to people who work in shops. Because that's what it says in the Sunday Trading Act 1994.

Will you be required to work every single Saturday and Sunday?

Only putting new employees on the new contracted days is ridiculous and is more unfair than what Ocado are proposing. I'd be royally peeved if I started a job to find I was the only one doing weekend shifts just because I'm new.

The question was 'can they do it' to which the answer is 'yes - they just did'.

The real issue [yet again] is what can anyone DO about it?
If you haven't got it - please don't flaunt it. TIA.
