URGENT help required, lowell not providing proof and demanding money

hi folks, in march 2011 i received a letter from lowell about a debt from 3g which i did not acknowledge, i wrote them a proof it letter beginning of may 2011, they wrote back to confirm they are requesting original documents from 3g and it will take some time, 2/3 weeks later they write to me that since last correspondence they have not received repayment and that if i dont pay they will take matter further..

i thought unless they provide proof then they cannot do anything??
even in the process of retreiving documents they cannot harrass me to pay for a debt which is not mine...

can anyone please give advice on what to do?
do i report them to a governing body for breach of conduct?
if so, does anyone have a template letter to report them?

did you have a 3 contract? If yes did you pay the final bill or did you think you paid and stopped the dd

You could write to them again, saying you will be quite happy to pay once the original contract & details of charges are provided. Unless they can provide this, how are you supposed to verify what you owe is lawful? No doubt they will continue in the meantime to send you threatening letters! (I don't have experience of Lowells, but am doing something similar with another company, ongoing for about 3 months now)..

everything was paid and done dusted, contracted ended back in 2009, now they asking £1278!! but my query is why are they demanding money after when i sent prove it letter, they replied saying they will try and get original docs from 3g and wont hear anything until they have proof??
i thought they have 28 days to get evidence in which if they cant - they cant do !!!!!! all - not even contact you, also whilst in dispute they cannot ask for money

so whats my next move?

Personally I would go to Fermi's sticky thread 'OFT Debt Collection and letter guidance - Read if you are being hassled'.

Send them a letter, include your original prove it letter if you want(remember not to sign anything!)

In your letter I would refer to your original prove it letter, the fact that they haven't produced any evidence and that under the OFT guidance (think from a brief look the section is 2.0h) they could be viewed to be harrassing you. Tell them that you don't expect to hear from them until they have proof and if you do you will be reporting them to the OFT.

thanks, i've just drafted a letter and will post to them recorded delivery in a little while, do you guys think i should write to lowell's complaints department aswell (not sure if they give a !!!!!)??

received a letter from lowells today, not received payment from you, given me 5 days to pay or they will take legal action, secure debt against house - but i dont own my house, also saying deduct from earnings and send field agents to negotiate with me debt repayment - its not my debt
i told them to prove it, send me proof but they are ignoring and demanding payment
please help..

That letter state "may lead to". The operative word is may. Firstly, as you point out, half the threats are impossible for them to action, secondly field agents have as much legal power as a the paper boy, third anythign that can do requires court action.

You have an absolute defence agaisnt court action; they have refused to prove that you owe the money.

respond to Lowell by reminding them of their failure to provide evidence, demanding a copy of their formnal complaints procedure and copying the Information Commisioner and the OFT uinto the letter. Then make a formal complaint and demand that they re-imburse you for your time and effort. £30 an hour is reasonable.

debt collectors write letters to try & scare you into paying. Stick to your guns.

Also under EU Regulations they are supposed to send you proof of assignment of the debt. You could ask for this as well.

thanks guys, i've written a letter reminding them the same thing i wrote last week to them about providing proof, also reported them to OFT, will be seeing my MP today in surgery to get help, also getting in touch with the information commissioner and credit services association.
my plate is already full of life's problems and these idiots do not help by pestering me, why do they have a license to carry out such behaviour??
