  • thanks for all replies, hopefully it wont come to the worst case scenario. as regard benefit's etc this is the last route i wanna go down we can live comfortably on my partners wage so we are very lucky.however i am the sort of guy who will take a menial minimum wage job as it annoys me these people that don't do that so lets hope if i do find myself out of work next week there is at least some factory/warehouse/driving work out there. we live in a fairly central area with 2-3 big cities within travelling distance so it shouldnt be too bad. hell ill even deliver pizzas!! (in my 3litre car!!!).

    I think you might live near me (there aren't many locations with 3 big cities nearby). Make mine extra pepperoni and extra mushroom :)

    Good Luck, one comment I would make is that your employers were under some obligation to provide a written statement of employment within 2 months, since you started on a temp contract (which I assume was written) did it have a rolling clause, i.e you will continue to work on these terms unless told otherwise?

    The employer does have an obligation to ensure that you have the knowledge to do the job and inform you of company rules but it does depend on the offence and usually gross misconduct is only used of those offences that are mostly standard. i.e not stealing, abusing staff etc

    However generally your employers can dismiss you if you have worked for under a year - they can simply use this as a means to dismiss, rather than go through a disciplinary process which might have them justify why despite having no contract/documentation/handbook you should have know the offence was gross misconduct.
    If they use the under the year rule you will be entitled to one weeks paid notice.
