    As always thanks SarEL.
Yes he did not use words victimization in that sense but suggested that I may claim for victimization in ET request.
He also did not look at evidence to decide but to see what was agreed and what is done thus suggesting that I may tell ET that employer is not fair.

I am going to write ET but I am really worried that if the case is really re-instated then I will be in the same stress game for next 12-18 months.

Can I request ET to issue Stay order for next two years until royalties issues is resolved?
It will be based on the argument that employer is not trustable.

    Thanks Womble
I want to end it here but then there is always desire to fight for your rights.
You are absolutely right that in the end its going to be very bitter fight (its already is). The sector I work in has only three top companies in this city with one my previous employer, second current employer and third has crap salaries and worst working conditions.
Thus in the end (or even now) likelihood is that I might need to change cities or even country if it gets even bitter.

The way I see is that I have good job, family and excellent friends in this lovely city which I love thus I should cut my losses, move on and not make MORE enemies.
But I feel like a loser and there is desire to chase my losses

Hi Fabio, I have no legal advice to give you but I have read all of your threads with interest so this is just my personal opinion.

The way I see it is that you have had all the advice that anyone could reasonably expect and now it is only you that can make the final decision on this. If anything you have had almost too much advice and now you cannot think clearly and objectively. I think that you need to make the decision on whether you want to end this now with the outcome that you have or vow to fight this to the bitter end (if this is even possible) and deal with all that this entails. No one else can do that for you.

I hope that whatever you decide is right for you will finally give you some peace of mind and allow you to move on and enjoy the rest of your life.

No you can't have a stay for 2 years! As I told you, you need to get the agreement down in a COT3 and tied up. Then if they do not stick to it you must action it through the County Court. Once a setllement is agreed properly then the ET will dismiss the case - it is not any of their business whether the employer sticks to the agreement. Not just in your case - in any case. It is then a matter of contract law and a different branch of the judiciary.
