can anyone give some advice please Ihave recently received a letter from a debt agency requesting payment for a debt i had from capital one from some years ago. Can i claim back any charges that they may have made ie for a late payment. As i remember it the debt was a lot smaller than what they are asking for now thanks

I believe you can claim back up to 6 years ago. Martin said the other morning on tv that you can even claim back charges where you no longer have an account. Check out Martin's article about it for info. Good luck
Thanks to MSE, I am mortgage free!

Do you acknowledge you owe it?
If you are not sure, write asking for a copy of the original loan agreement and proff that they own the debt. Make sure you include that you do not acknolwedge the debt, and need their documentation to clear things up.
If they cannot provide this, they cannot pursue.Debt free 4th April 2007.

Pay The Debt But Not The Charges Make Them Take You To Court For Them0
-
what about the interest charges as it was a few years ago thes maybe considerable0

Maybe, but firstly you need to see if you are liable.
Number 1, send £1 and ask for a copy of your signed credit agreement and statement of account.
Number 2, if this hasn't arrived after 12 days, can't be enforced without going to court, and after 30 days, an offence has been committed.
Number 3, if you get here, send a subject access request for all documentation relating to your account and claim those charges back.0
