    Might be slightly more complicated given that OP has said he earns £20k per annum meaning he can't go down LILA route. However, it is still far easier up here than in England and Wales, not to mention cheaper! (Just my humble opinion I hasten to add)

    Presumably as you are looking at wages arrestment, there is already a decree/charge for payment allowing you to petition immediately for your BR?

    If there are any detailed questions then it might be worth PMing coolcait, as they are very clued up on the system up there.

    I've tweaked the thread title to make it obvious this is on Scotish BR. That way anyone with direct experiance can see that at a glance on the board.

    gillypkk, so what happens then? Is it just paper-based or do I go speak to someone as well? And what happens with the Insolvency Practioner, are they in charge of my money or what?

    Wildheart83, when I say I earn £20k, my basic is only £14k odd, the rest is optional overtime.

    Yeah fermi, a decree has already been granted, NDL said they would send out the appropriate forms so just waiting for them and you guys will be hearing from me again to fill them in!

    and can I just have a little moan about the bank...I know I signed agreements etc and I know it's joint and several liability, but I just can't believe someone can run away from debt like this. The reason it's come to this is because I was honest at the start and replied to letters/answered phonecalls etc and tried to pay what I could. I gave the bank my ex's address, where she worked and how much she earned and they said they couldn't act on it unless she told them where she was. So the moral of the story is if you're honest and have any integrity, you get ruthlessly punished and your life gets put on hold for 6 years, while the other party can carry on as normal :( **

    I will join you in that club :eek: that almost mirrors my own situation, good luck poor soul, I also found honesty and integrity gets you no further but at least you may go financially BR you won't be morally BR like both our ex's and that is worth more than anything in my book. :D MC

    hear hear MC. The only good thing is that once I'm BR, they will finally go after her :)

    It just baffles me the lack of common sense in our financial industry, as if someone who is running away from debt is going to phone up their creditor and tell them where they are, absolute idiots!

    I'm going to write a very strongly worded letter to my old bank's CEO over a can of beer once all this is over, pointing out the deep flaws in their red tape-ridden procedures and completely idiotic mentality!

    can anybody tell me what to enclose with my forms? Obviously all my supporting documentation, payslips etc. What about a personal budget sheet? There doesn't seem to be a section for that?

    As far as I can remember, they don't require your SOA at this stage. Bearing in mind it's all changed from when I went BR last year.
    If you miss anything out you'll get a phonecall or a letter asking for it so don't panic.
    I included all the statements I had for each account I was including in my BR, there were also some duplicates as I had statements from the creditor but also from whichever DCA it had been passed onto.

    If you're unsure just give the AiB a call, they're really friendly and helpful.

    thanks wildheart, just making sure because it says about a hundred times throughout the forms about completing it fully and sending documentation or they'll reject it and I'll have to pay another £100!

    I'll phone AIB in the morning :)

    That's what worried me too, as the CAB didn't really explain it to me in great details.

    I don't know if it's an option but if you're handing in the form rather than posting it, they offer to get someone to check your form before they formally accept the application.
