Copies of CCA agreements

If I request original documentation of CCA, and am shown a photocopy/copy of agreement not the original, does this count.

I know there was ONE case where a judge said copies are fine, but that does not set a standard

Any thoughts?

Thanks

It is a DCA by the way and I requested CCA agreement from them

So I guess it is a case of sending them letter explaining how much I can pay back and no more each month

Andy - without knowing more about the specifics of your situation, no one can answer your question. If your card was taken out pre-2006 and you want to investigate google niddy and unenforceability

Too be honest a pretty big % of the time they will send a photocopy of the original but that doesnt mean its right. Infact theres probably a better chances of picking errors in an original that a re constituted copy.
As above you need to have a search around(see above).

they are not going to send the origional, only a copy or you would just destroy it
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

Originals are rarely held, just copies of the original (be it microfiche etc)

Some judges (during litigation) have been known to accept reconstituted agreements (which technically, they shouldn't). You can still fight your corner with a recon, but you really need to research, as even the judges are not fully conversant with the cca act and you need to put forward a watertight defense.....

    THanks for help everyone

It is a card from 2000 (credit card) it is now with 1st credit and although I thought it was paid off it is not. So they contacted me and I requested CCA, which they gave me as a copy. SO not entirely sure of my next step/options?

as said previously google all about debt, website specializing in unenforceability of CCAs. needs to be checked properly before you tell em anything else.

Why did you think it was paid off and when did you make what you thought was the last payment? Could be statute barred depending on those answers!
