If the finance is coming from Creation and the only agreement the OP signed is with Santander then either Santander sold the deal on to Creation or the dealer, for whatever reason, changed the finance company and must have forged the OP's signature on the new documents.

The fact that Santander originally told him they knew nothing of the deal suggests that the latter option is the case.

The question arises as to what happened after the Santander agreement was signed. In my experience I would have thought that Santander would have needed to have approved the deal prior to signature on the CCA so, if it got turned down, the dealer may have gone for an alternative. This being at a higher rate might have jeopardised the sale, in which case he got the OP to sign on a Santander agreement and then copied everything over to a Creation form.

When you get a copy of the CCA, you need to look very closely at the signature.

No matter who owns the paperwork, what does it say at the top?

Is it a HP agreement or a Personal Loan agreement?
For it to be possible to return it at the half way point, it MUST be a HP agreement.
