online Small claims court

Hello
my boyfriend is wanting to take someone to court
the story cut short
Boyfriends car broke down didnt have the money to fix it before its MOT
Friends friend is a mechanic who offered to keep the car on his land(he has many cars) as long as he paid him to fix it when he had the money
2 months later boyfriend whent to his house with the cash so the mechanic could start fixing it and the mechanic has got rid of the car saying his landlord made him get rid of it (but at this time had 6 other cars on his land and i have pics) my boyfriend thinks he sold the car as the mechanic did call him after the car had been there a week saying someone offered £500 (it was a porsche 944 with some fancy wheels that are ment to be worth alot:confused: )

so he is wanting to take him to the small claims court and amsure you can apply on line for this

anyone any recomendations

    He cant sell the car if he ain't got a log book, write him a letter saying he owes you so much money and he has 30 days to reply with payment, if not then you will take him to court where he will have to pay court fees, 8% interest and will have to pay in full if he is found guilty.

    You will have to pay court fees to claim but as I said if he is found guilty then you win, also if he doesnt turn up, you win to!

    It's worth noting that if you file a small claims petition online and you have to appear in court you will need to go to Nottingham. It might be more convenient to file locally in person as the case will take place where you file it.

    Why not start by reporting the car stolen to the police? You can find out if it's been taxed and is back on the road by going to the DVLA website - all you need is the registration number and make. It won't tell you who has it though, but the police should know this........
    Also, if the mechanic did sell it then the new "owner" has (maybe unknowingly) received stolen property, so has no claim to the vehicle. You get the car back - let the new owner sue the mechanic for his money back.....

    He's running a Porsche with "fancy wheels" but can't afford to fix it?

    Maybe you need to look beyond the boy racer for your choice of suitor?

    Anyway, moral lecture over................if the car has been sold by a third party without your boyfriend's consent then he should report it stolen and claim off of his insurance.

    He did have insurance didn't he?

    he is 45 not a boy racer and got laid off at work can happen to anyone it was only a 3k car but the wheels on there were a grand new (not that thet were new):cool:

    edit - and the please wont register it as stolen as it was on his land they said the only thing to do is go to court

    You'll gain nothing by going to court.

    The honest answer (appalling as it is) is for your blokey to go round and knock seven bells out of his "friend" until he (his friend)

    (a) tells him who he sold the car to and

    (b) gives him his money back
