Stuck and don't know what to do

I am hoping I can get some advice on here.
My situation is dire and I don't see a way out. Got a mortgage with northern rock 3 years ago for 160,000 with a further 15,000 in unsecured loan. We owe 151,000 on the flat and it's only worth 143,000. The neighbour upstairs has made our lives a living hell and it's becoming impossible to live at home. The flat has poor soundproofing between floors and she refuses to communicate let alone agree a soundproofing solution. We are going through the normal processess re neighbour disputes, but being there every night produces some form of drama. I am beside myself. I am wondering if it's just easier to declare bankruptcy.

does the neighbour own or rent?
If they rent there might be a light eventually.0 -
she owns as well - there is no light. we have tried to communicate of several occasions through various means to no avail. problem is, I need out, right now. can't live with this stress anymore!0

8 grand of negative equity doesn't sound too outrageous. Can't you just sell up, take the hit and move?0
-
I don't think it will sell easily as there is now a neighbour dispute that has to be declared unfortunately.Life is not the way it’s supposed to be. It’s the way it is. The way you cope with it is what makes the difference.0

I really want to sympathise with you as I know the agony you are induring right now and the sheer desperation you feel when there is just nothing you can do to communicate with an unreasonable neighbour. It happened to us many years ago and we took the hit - sold the property for less than it was worth just to get out. Doesn't seem right or fair but a huge relief and nobody, and I mean nobody, can ever understand what it is like to live under these sort of conditions unless you have experienced it.
Sadly, you have negative equity. We were fortunate enough to have some equity at that time so we could sell up.
Would NR allow you to rent out the flat and then you rent somewhere else? If you managed to get young folk/students to rent the person upstairs might get payback.
I know there is no easy answer.

No, Don't do any of the above - You have more of a 'Right' to live there as she does?
I would be 'Bangin' on the door everytime the noise started !!
YOU HAVE TO BE FIRM With these types of people, These types who get their Rent, Bills, and more paid.
I dealt with a neighbour myself only 2 months ago, I told them STRAIGHT - Didn't swear, But shouted You mess with me my Bark is harder than my bite.....
They have never troubled me again as yet !!
By the time you have made complaints to Landlords, Council, Or even the police - You might as well deal with them yourself and tell them that you MEAN what you say !!
There's thousands of idiot neighbours in this country, Being a soft target is not an option today.
Best Of Luck anyway.:beer:Thomson 757 Man0 -

That is so true. OP, good luck in whatever you do.0 -
Thanks all - forever summer is right - you just can't understand what it's like until it happens to you.
We HAVE banged on her door, we HAVE told EXACTLY what we think of her and that we're NOT moving - she has involved the police, told them a bunch of lies and now we're under investigation for threatening behaviour. The frustrating thing is my relationship is falling apart - he can't keep calm now. with her knowing we're under investigation she is antagonising us even more. bashing on the floor - stomping around all night - and her blatent disrespect is what is fueling the feud.
my stomach turns to water everytime I hear her bash her front door when she comes home. I can't continue. I don't want to go home.0 -
Surely CCTV and other recording equipment has a role to play here to support your argument to the police and local council. If she is banging on your door etc. then its harrasment.
You just need the proof to get away from he said she said.0 -
We have dvd evidence now, and log. submitting to police tomorrow. too bad there's no quick fix. I just knew getting a mortgage was a big mistake.0
