ex partners debt

Someone suggested I post this here and I'm not sure if I have posted it in the correct forum.
Hoping someone can give me some advice on this....

Today I have received a letter from a debt collection agency asking for £1367.65.
Apparently this debt is in relation to a joint account I had with the mother of my 2 kids. We have been sperated for over 8 years and I have had nothing to do with the account in that time....completely forgot about it tbh. She carried on using the account after we split up.

I have phoned the people who sent the letter and explained the situation, they told me to phone the Abbey National. I did this, again explaing the situation. They checked their records, which only go back as far as October last year , this debt being on the account then also. They say that because I am apparently the main signatury (if thats right) I am the one liable for it.

I have spoken to my ex , who is away till the end of the week and she claims that she has not used the account in 4 years and can do nothing about it till she gets back. I know that she can in no way afford to pay this.

So does anyone have any experinece with this and is there a way out of this or am I going to have to pay?

    Ooops, take it you forgot to get your name taken off account when you split up.
    In that case you may well find that you have a liability.
    Take it your ex has been dealing with it/paying it up til now.

  • You need to get hold of the withdrawal records etc. Go and speak to CAB - you may find that the CSA (assuming you are the NRP) will take the debt into account and recalculate maintenance based on it (I think it's only if you're on the old scheme though).

    If not they may have more advice.

    Legally, if it's in joint names (i.e. joint signatories - the 'main' bit is irrelevant), they can persue either/both of you. And the debt isn't statute barred until it is six years since it was last acknowledged. So it looks like one of you is going to have to pay something.

    But if I was you, I wouldn't pay anything. If your ex has run up the debt, let her sort it out. She can probably get some 'pay by instalment' deal or a 'full and final settlement' deal. Get her to post all her debts on this board and we can point her in the right direction.
