I think the law says that you have to write to them and give them a chance to come and get the item at their expense. If they don't then after approx. 6 months it's yours.0

I take it Chocmonster7 that you're not a solicitor?
If Argos had taken the money twice, by mistake, would you expect them to refund you? It's not the taking part but the winning that counts.0 -
Chocmonster7 is correct, that is advice that I have heard FROM SOLICITORS.July Win: Nokia 58000

I felt awful as this might have been all the money someone had on them etc. Still feel for the poor person who lost the money though.
In this situation or in a shop I would never hand over any money found but inform them that you have found money and it will be handed into the police. The DJ then could have announced this instead of his suggestion. You then take it to the most convienient police station for you who in turn will send in to a central lost and found for the area concerned or forward it to the relevant force concerned if it is another. You are given a receipt and if the money is not claimed after two months you can claim it conscience clear within the third month.:j0 -
It's definitely not stealing. Just keep it. It's not often you get something for nothing.0

benykeny wrote:Hello,
I recently ordered an mp3 player from Argos, and it seems they've got it wrong and sent me two by accident. It would make a handy christmas pressie, so I'm wondering if anyone knows my rights if/when they realise? I assume they are entitled to take it back, but I just wanted to confirm if this is definately the case? Is assume I can force them to organise delivery. Could I buy it off them if they demand it back? I wouldn't mind paying for it anyway. I've had a quick search for consumer rights and can't see anything specific.
Thanks
Once i thought something got lost in the post sent from ebuyer.com it was a week didnt come so they sent the product out again so guess what i got both the one i thought was lost and the new one sent out. I rung them up told then they said as its under £100.00 dont worry about it keep it0 -
I've finally found a relevant bit of legislation, if I were benykeny I'd still tell them about the duplicate and then they would have a clear conscience!
http://www.dti.gov.uk/consumers/buying-selling/unsolicited/index.html
Under the Unsolicited Goods and Services Act 1971, (as amended) it is an offence to demand payment for goods known to be unsolicited, in other words, they were sent to a person without any prior request made by them or on their behalf.
Someone who receives goods in these circumstances may retain them as an unconditional gift, and does not have to pay for or return any unwanted goods. Anyone who receives a demand for payment for unsolicited goods should report the matter to their local Trading Standards Department.
However, in the case of unsolicited goods received before 1 November 2000, the recipient is required to give notice to the sender to collect them within 30 days, or otherwise to wait for 6 months, before being able to treat the goods as their own property.
dbonbon - I'm not a solicitor - have just learnt a few things while hanging around these forums!0 -
I think it depends what it is.
If it were a £20 mp3 player I think I'd keep it and not give it a second thought. If it were a £250 mp3 player, however, I think I'd have to notify them about it. I'd consider it a poor effort if they didn't give me something to reward my honesty though.
(yes, I know we should all be honest anyway, but a gesture never hurts. You'd better believe I'd give someone a tenner if they gave me back a £250 mp3 player I'd lost...)0 -
Apologies Chocmonster7. I have read my response and it does come across the wrong way. I was not having a dig it was just your response made me chuckle. SORRY!It's not the taking part but the winning that counts.0
