Me again. Spoke to them today and asked some questions. She said they own the debt but they have no CCA and I'm to ask HSBC for it??

    Opinions please.

Send them the letter requesting it - phonecalls don't really count for much I'm afraid.

Add in a bit at the start saying further to telephone conversation you are writing to request CCA and as they are the creditor, they are unable to enforce the debt if they do not comply with the request in 12 days. As the original creditor no longer has anything to do with the account you will not be requesting it from them.

Sounds like they were just trying to fob you off on the phone.

If they reply with some garbage just reply saying due to the fact they don't have CCA, you will offer a generous £1000 in full and final settlement of the account.

She went very sheepish when I asked if they had it.

What are my chances of them going for a settlement figure? Also, does a DCA still have the same rules surrounding a CCA as a bank?

    bump...

Anyone know what I do if the DCA doesn't have a CCA? Also do they have the same laws applying to them as a bank? I'm wondering why a DCA would have the CCA.
