    quick update.

My father seen a solicitor today, and the solicitor said he would be liable to pay half of her debt since the debt happened during their marriage?

You're father needs to get a better solicitor.

What a load of complete rubbish!

    Hi, thanks for the replies.

My father has definetly not signed anything, except for the remorgage of the loan they took out to help her business.

His solicitor did say that he wasnt 100% sure and he would confirm..... doesn't sounds like a good solicitor to me.

He said that because the debts accrued during the marriage he would be liable for the business debts.

is there anyway he can find out if his signature is on anything to do with the business? He defintly hasn't signed anything willingly.

If I was him I would still take Penelope Penguin's advice and get him phone Business Debtline or National Debtline.

    It's free to phone.

    http://www.nationaldebtline.co.uk/

    http://www.bdl.org.uk/

We can give an opinion here, but it's no substitute for one-on-one advice from a proper debt advisor.

If he talks it though with one of those, and they still say "No. Not your problem", then that will give him much more confidence and peace of mind than and 3rd party opinion on an internet forum can.

    If not, then he should.

At least the people there will know what they are talking about regards liability for debts, unlike this 'solicitor' who sounds like a right clueless numpty.

I smell something and it's not roses.
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark

    Forgot to update.

My father rang the business debtline and they confirmed what most of you are saying. He is NOT liable to pay off any of the debt and he is NOT liable to pay of the loan if he can prove it went into her business, which he has bank statements showing.

Many thanks for all your help.
