I'm not 100% sure on this (ask Citizen's Advice Bureau (CAB) for free legal advice), but I think it depends on whether she made any contribution to the mortgage?
If she can prove that she made regular, significant contributions to it from her own money she might be able to claim a proportion of the property.

I always seem to say this but I split from my wife and my children, I stayed in the house for a couple of years. First thing I did was get a lodger in my 4 bed house, nice young lady who paid me £300 a month to share my space. Thats a big help every month if you can get it. If not then ring the council and reduce to single persons 25% discount on council tax.0 -

I wouldnt worry about this right now, get the other things sorted and into some sort of order, you can then take some legal advice on the house. If she so wanted she might ask that you provide somewhere for your son and her to live, called alimoney but rarer these days. You will of course be expected to pay child maintenance for your son though, that will be based on your take home pay which will be £390 per month.0
