Help

My daughter has found out her husband has added £58 thousand pounds to the mortgage. She is hoping to get him out of the house without him having any money from it as she did not sign for one of the amounts on the mortgage.They are now getting a divorce and she is hoping to keep the house although on her wage normally she would would not be able to afford the house, we think. We are working together to try and make this work by getting together a business plan to present to them. As they have not yet divorced can she aproach the mortgage company or should she wait untill the divorce details have been sorted out something that will take a while as she is waiting for legal aid.

    What happened to the £58K and did she sign to agree to this extra borrowing ?
    Do they have kids and has he got a good well paid job.
    Time to talk to a solictor and inform the bank

    Yes he has a good job actually with the bank the mortgage is with and he worked for some time in the fraud department! £32 thousand we don't think she signed for but he did turn round to her once and say your signature is too easy to copy!!! The other part of the money was signed for by her and it was taken out to pay for a loft extension something the council refused on application. Her husband told her he had paid it back. They took out another what she thought was £36 thousand two years later to pay for the loft extension when the rules governing extensions on houses changed only to find that he had applied for the loan to be £62 thousand this she signed with him saying you needn't look at the paperwork, although she asked, as he had already read it all through. You see she loved him dearly and beleived his every word. The day she found this out we came out of the bank with me having to literally hold her up she was devastated and has been talking of suicide ever since, this is why I am desperately trying to help. She does have a solicitor but her hands are tied untill legal aid kick in. There are two children and my husband and I can be guarantors but at the age of 65 I don't know if they will allow us to be.

    I don't understand where the £58k comes from as it seems that loans for £32k and £62k are involved? It all sounds very messy and I don't think compiling a business plan is going to help. Has the solicitor at least given a bare bones explanation of the way foward?

    If I understand it's £32k which is absolutely disputed (i.e. no signature/agreement) and £26k (£36k agreed but £62k actual)

    Secondly I must be living a sheltered life being happily married and never involved in divorce but why the hell can you get Legal Aid for divorce :shocked:

    Sorry should have been £68 thousand in dispute not £58.

    And sorry again I have confused the situation by waffling on about what has happened. All I need to know is about the mortgage should we approach the the mortgage company now or not and if so what details we should be taking with us if we do.
