Help, payed for next day delivery but took 2 days

Does any one know what my rights are:
I bought a lens from Jessops online & payed extra for next day delivery. I stayed in the next day & it cost me a days wage & time. You guessed it, it didnt arrive till the following day. If I have payed for this next day service & it has cost me a days wage can I claim that back as well as postage.
Also Jessops had these lenses up for £759 but no stock then suddenly all in stock but went upto £899, smells like kippers to me.

I don't think you can claim for lost wages, otherwise they'd have to know what you earn before taking the sale.

    some people earn £5.25/hour = £40 ish a day
some people earn £2000/hour = £16k per day
Check the T&Cs on the jessops site to see what you can get.

Not really ....... Jessops were contracted by the op to supply and deliver the goods. Although Jessops subcontracted the delivery to another company they are ultimately responsible.
  • It may seem like a daft question but the website doesn't have a time you have to order by in order to get next day delivery does it i.e order by 4pm to qualify for next day delivery and any order taken after this is classed as ordered the next day.
Quite a few of them do have this.
I hated going to weddings. All the grandmas would poke me saying "You're next". They stopped when I started doing it to them at funerals :p

It does have a cut off time but I was well within its time & I was given a delivery date for the next day. I contacted jessops as to why it wasnt delivered & they are blaming the courier.
I just feel that because I payed the extra I should be able to claim compensation other than the post.

I am not sure you can claim compensation for loss of wages. However even though a 3rd party that being a courier were involved, surely it would be the retailer who employed them? I think probably all you get is the money back for delivery.

I would have thought that you will only be able to claim the postage back and have it as though you got free postage. They may offer some vouchers by way of apology but they dont have to, however the least they can do is refund all postage paid.

    In thier delivery T&C

Jessops cannot be held responsible for parcels delivered late due to circumstances beyond our, or our carrier's control (such as traffic conditions, adverse weather, acts of god etc.)

    Kind of covers all bases
  • Yep - but that's a standard force majeure act. If they didn't turn up at all they should have called at least. He wasn't late - he just didn't turn up it seems!

We dont know that... A lot of bad weather recently... Flooding and stuff.. Anyway I have never had a courier company call me to tell me its not coming... The closest I got to that is checking order status on couriers website to see if its been dispatched for delivery.

You would need proof that the parcel was in the van and he just went home instead of delivering it to say he didnt bother turning up... If it was too late to deliver or there was no way he could have reached the house before the deadline time or his shift ends then this counts as being late..
