I'd be asking them to prove it first of all. See what they come back with, if anything.

But by the sounds of the link I posted something will need to be sent back in defence, hence personally I would go to CAG concerning this.
I all have learnt is from others on many sites.
    Seek legal help if unsure.

One thing I'm not clear on with DROs is that whilst you have to owe less than £15k I don't know how statute barred debts are treated. After all just because a debt is statute barred doesn't mean it isn't owed.

If anyone knows for certain how SB debts are treated in terms of the limit for a DRO I'd be interested to know.

    Found this online: -

    Q. Will a statute barred debt count towards the £15,000 debt limit?
    A. Yes it will. If you need to exclude it in order for the client to qualify, you will either need a court order dismissing the creditor's claim or a letter from the creditor confirming specifically that the debt is statute barred and therefore unenforceable

If its statute barred then you should eventually be able to get a letter from the creditor to agree this.
So if you reply with the SB template and they respond to say they agree and won't be chasing the debt further then presumably at that point you could consider the DRO again?

Well that would be the hope Tixy but unfortunately I don't think it is going to be easy getting them to acknowledge that given the information on the other forum that was posted earlier. Bit of nightmare. I also spoke to National Debt Line as i read they were aware of the situation but no successful outcomes as yet but the limitations act arguement seems to be the way to go..
