Cahoot/Santander/Moorcroft
Dear all,
Your help / advice greatly appreciated on the following:
I had a cahoot flexible loan which I couldn't keep repaying since about 4 years ago, and I managed to get all the interest and charges frozen.
I was paying £50 a month on a debt of around £6000. That was OK by me. Then, cahoot was bought by Santander a while back.
A couple of months ago, they informed me that since my account was in arrears by about £1,000 (my total debt to them is now about 3,600) it was being transferred to a DCA unless I could find the £1,000 for the "arrears." These arrears arose because I wasn't making their "minimum payments" of around £120 (which they never even informed me of), but rather the £50.
I talked to them on the phone, the 1st lady was horrible, the second very heplful. She told me that the loan should have been properly defaulted a long time ago by cahoot, but they never actually really did it. Santander were just clearing their books as it were, passing on the bad debt I guess.
As I mentioned, I told her that my loan had 0 interest and charges, as agreed with cahoot (I have the letter to prove it). She was most surprised, but anyway, I digress.
Last week my family recieved a standard type letter from Moorcroft requesting that I contact them, which I haven't yet done. I say my family, because I no longer live in the UK! Don't know if this changes much...
My question: some people have suggested writing them a letter about there not being a CCA - in the hope that the debt may eventually get reduced...not that I dispute that I owe it (even given cahoot's original arbitrary interest rate hikes that caused the default in the first place).
Should I do so? Or just give them a call offering to pay £20 a month or so? One factor is that I really don't want any people calling on my family back home in the UK - not fair on them.
Many many thanks for reading and hope to read your advice soon...

Cant tell too much from your post on the kind of loan. Was it a flexi loan (from your interest rate comment)
I had joy recently with the FOS getting Santander (formerly Cahoot) to return 5K+ in unfair interest.
I asked for my CCA from 2002 and they supplied it within 10 days, and my CC from older, to my surprise. So I wouldn't hold much hope they don't have it, but worth a £1 to the DCA to find out.
