Disciplinary hearing help needed

  • Well, I went to the meeting today. The manager had made a signed statement which said that I told her where her file was and that it was full of complaints about her from the owner and his wife. Previous to this she had no knowledge of the existence of her file!! I then opened the filing cabinet (which has a very simple lock which can be opened with any key so not actually breaking it) and showed her the file.

I denied all this told them the truth, that I had read my own file but nobody elses and the manager already knew her file was there and had read it before.

By the end of the meeting the owner just looked totally confused and told me he didn't know who to believe and that he would make his decision later and phone me tonight.

He has just phoned to say I can come back to work on Wednesday and this will be my final written warning. I asked him for confirmation of this in writing. Now totally confused, definitely didn't expect to be going back. No idea what he has said to the manager.

When the final written warning is issued it should be clear what this is for.

Insist that you get a copy then post it on here and we can discuss it. Ultimately you have to be treated fairly. If the warning is a bad attempt at their trying to justify putting you through this then you should be able to appeal.

This *company* that you work for sounds totally and utterly ridiculous. I'm having visions of Fawlty Towers, and Basil thinking he's running a company the size of Tesco's.

It sounds like they need Gordon Ramsey.

    :o

This really made me laugh. You have no idea how accurate this description is. I won't be able to keep a straight face the next time he tries to discipline me for thinking about Basil Fawlty. His wife would make a great Sybil too :rotfl:

You can appeal against a written warning,i think. If you have this on your file there is nothing to stop your employer stating this is a reference.Anyway as already said, get out,go elsewhere asap

  • How can you be on a final written warning if the company doesn't have a disciplinary policy? Ask for this in writing, and then ask for a copy of the policy. They are still breaking the law - you need a contract, a disciplinary policy and a written statement of what you are supposed to have done wrong.....

It sounds to me as if they are either trying to be fair or have realised that they will be in deep doo doo if they sack you without sufficient reason. I wonder if they have sacked your manager????
Ex board guide. Signature now changed (if you know, you know).
  • I'm back at work tomorrow. I have asked for a written copy of the final warning which should be waiting for me. I'll let you know what it says then.

As for the manager, I don't know if she will be there when I go in tomorrow. It could be interesting if she is - she is very volatile!!

    Any update from this?

Hi again. Well I've been back at work since before christmas. The atmosphere was very frosty at first but seems to have quietened down since. I've just kept my head down and got on with my work.

My written warning has given me three months to improve my performance, and a list of instructions including keeping files confidential unless told otherwise. The manager has not received any warning, verbal or written and her part in all this seems to have been totally ignored.

I'm still looking for another job but its hard finding something to fit in with school hours.

I've also just been issued with a written contract including disciplinary and grievance procedures!!

Well, good news at last!! Since my last post I have continued working here, got on with my work, and carried on looking for a new job.

The manager has resigned, she found a new job and left 3 weeks ago which meant the owners have had to move back in to the hotel. The housekeeper also left so they now have to be in the hotel 24/7 except when I am at work so I have had plenty overtime recently!!

I have now been offered a new job which is perfect for me. The hours are ideal, pay is same as I get now and there is a good chance of promotion in the future. Now that I have told my boss I am leaving he is falling over himself to be nice to be, trying to convince me that I should stay here!! How things change.

Anyway, thanks for all the good advice I had from everyone here in December. Just thought I'd let you all know about the happy ending.
