Resignation while on paternity leave

Good afternoon,

My wife is currently 9 1/2 months pregnant and I am due to go on Paternity leave when labour starts.

The question I have is... I have been offered a mew job, can I still take paternity leave if I have handed in my resignation?? Could I spend my 4 weeks notice while on 4 weeks paternity?

Thanks

James

    Congratulations.

Yes, you can still take your paternity leave. However, you can't start your paternity leave until your baby is born and babies will come when they want. What I'm trying to say is that you won't have the service requirement for paternity leave with your new employer so you will still need to be employed by your current employer, so you will need to think about the best time to resign.

I suggest that you tell them that you are going to resign and you will work until you start your paternity leave - have your two week leave (its two weeks, not 4) and then you can start your new job. If you are on a standard 4 weeks notice, it should work out.
