Can you complain about debt agencies??

Hi,
I complained about 1st credit to their organisation they say they're a memer of (believe it's csa). I stated it was not the chasing of any debt I was unhappy with but the manner of it. They basically don't want to know.
So anyone else I can complain to or do we just ket them carrying on bullying people??

  • Hi, are 1st Credit a credit collections agency? I had the same problem with the company who collect on behalf of Capital One, they are rude and just nasty. Anyway, I complained to capital one who my original debt was with but also called the financial ombudsman (google it and you'd get the telephone number), they said unfortunately collections agencies do not have an ombudsman and therefore are a law unto themselves. Great, so they can act however they choose! The best thing that i found to do (and was also advised this by the cccs and citizens advice) was to ignore all calls from them and only act via post. I just found myself getting so worked up by them it wasn't worth it.

    You should look at the Office of Fair Trading website, to see the guidelines to which DCA's are SUPPOSED to adhere. If 1st Credit has been ignoring these guidelines you CAN and SHOULD report them to the Trading Standards Office - I would reccomend that you report them to the office closest to their registered address.
    Copy ALL correspondence to the original creditor.

    Congratulations you've got it in one! They are chasing 2 debts - 1 7.5 year old debt. I have sent them the 1980 6 year letter but I got a letter from their solicitors this morning saying they know I own my house and if I do not settle then they'll go to court and push for a sale order of my house to recover the outstanding £987! I know they're just trying it on but this is just wrong!
    I advised in relation to the other'debt' which is bank charges that were agreed to be wiped in January that I would get it in writing. The lady started to go on about you can't change charges..you owe them. It's not something you can do so just pay us.
    Ist Credit belong to a credit association by the way.

    This is definitely harassment and also intimidation which is ILLEGAL.
    You can complain to their Credit Association, probably CSA, but I doubt if you'll get any joy.
    I would be inclined to go to the CAB and ask them - they will probably reccomend that you speak toa solicitor, and should be able to give you a list of solicitors who give a free 30 minute consultation.
    You could also try a pm to either File_Wizard or McBIRNIE25 as they are well versed in these matters.

    The Administration of Justice Act 1970.

    Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:

    (a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation;
    (b) falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
    (c) falsely represent themselves to be authorised in some official capacity to claim or enforce payment;
    (d) utters a document falsely represented by him to have some official character or purporting to have some official character which he knows it has not.


    If the "solicitor” is a member of the law society then send the LS a nice letter asking why one of their members is behaving unlawfully in this manner.
