Halifax - pure greed !!

Well, Where Do I start !!

Has a Halifax Repayment Mortgage, Had it over 2 years, ALWAYS paid it when due.

Wife became redundant in January, We consulted the Halifax STRAIGHT AWAY.

Now to cut a long story... They are commencing Legal Action because we are in arrears of 2,000 +

We have liaised with the Halifax at EVERY step, And continued to make payments, This month we have paid the FULL amount due.

We have contacted several different members of staff, And most of them have said - Just pay what you can afford, We did have a regular payment 0f 200.00 for 3/4 months and they seemed 'OK' with that.

Until last month when they UPPED their GAME and started sending out more serious letters and now this week a Solicitors letter !!

We have contacted their solicitor and they have contacted us regular and I have sent off a means enquiry form to them that has been received.

Now they are talking about applying for a 'possesion Order' in a local Mag court.

We have also been waiting for what they call a MI12 FORM from the office of DWP, This is taking far too long now !!

An MI12 FORM is to help people pay the interest on their mortgage.

We have ABSOLUTELY had it now with the Halifax Bank !!

They have not offered any help one bit, And have 'Jumped' a gear and instructed their Solicitors whom are now also in the Arena making their % of the bill !!

Maybe a Buliding Society who were first created as Friendly Societies would have been a 'Bit' more co operative and understanding.

Not like these Banks who are simply GREEDY and wouldn't think twice about 'Evicting' a family fronm their own home !!

I'm sure there are alot of others in the same !!

    Could you switch to Interest Only while you're going through your bad patch?

    I forgot to mention Lol, That we do NOT have any other Credit Cards, Loans etc.

    Everything we own is paid for so no Loans etc on the property.

    Maybe, We are still waiting for the DWP to send us the MI12 FORM, This takes around 3 - 4 months.

    They will pay the interest on the mortgage.

    We are in the que somewhere !!

    I'd keep meticulous records to show you're doing your best in a bad situation. No guarantees but with the right magistrate the Halifax could be sent packing.

    In the meantime will Halifax let you switch to an "Interest Only" mortgage?

    So basically the Banks are now wanting the money back because they were 'Saved' and 'Rescued' by us - The Taxpayer.

    I say the Banks have caused this mess in a certain degree !!

    Obviously the Solicitors will be making their fair share - A Factoring process.

    I don't know how they can get away with it when someone is making payments on their mortgage even if it is not the required amount, Technically the mortgage is BEING PAID Full Stop !!

    A building society is no less likely to repossess than a high street bank.

    Use the link above, talk to CAB, Shelter or another debt charity.

    Also, talk to Halifax. Try to be calm and when you call ask for a supervisor. It sounds to me like some of your "arrangements" to pay less have not been made with appropriate collections staff. This could have led to the current situation.

    How much is your house worth?
    How much do you owe in total on the mortgage?
    At the end of this month, how much will the arrears be?
    What is the contractual monthly payment?

    I also found this link for you http://www.direct.gov.uk/en/MoneyTaxAndBenefits/ManagingDebt/DebtsAndArrears/DG_10013261 I would recommend as said before keeping clear record of all your contacts. From what it says on this page
    "Under FSA rules, lenders must treat you fairly and send you regular statements to keep you informed about your current arrears position. There are also rules covering what the lender must do if it intends to repossess your home.If you think you have been treated unfairly by a lender, you can complain to the Financial Ombudsman Service."
