Have you had a replyHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
Please note that any views i put forth are not those of my former employer The Insolvency Service and do not constitute professional advice, you should always seek professional advice before entering insolvency proceedings.0 -
Even if they did only put at Class C, it will have been repo'ed within the six months anyway, so you would not be liable.
Mine is being repo'ed on the 13th june 2011 and the council know this as had to show my court order to them, i dont think it has anything to with the repo i think it has more to do with how long it takes the bank to sell the property, if they havent by the time 6 months is up the council then govern you as still liable or try to by quoting the wrong band to people, thats what i believe to be true but i could be wrong.0 -

Thanks for posting this Leesmom.
You are welcome the more people who know the better, i am thinking of the people who posted on here who were made to believe after 6 months they would be liable for some or all the council tax and have actually been paying it, they would be entitled to a refund i would have thought:D0 -

But was the house vacant, or were they living in it waiting to be evicted. Most that go on for 9 months or so you will find the house will have been occupied.0 -

From the date of re-possession you remain liable for the council tax (you are still the legal owner) however a Class L exemption applies until the property is sold or re-occupied.
Thankyou so much for the information i wasn't aware of class L exemption, could you possibly explain why so many people are being put into class C by local councils surely they must know the rules and what class to band people in, i can only think its nothing more than a tactic to gain extra cash for the pot as this happens repeatedly with many councils, i have seen it here time and time again.0 -
The reason many will initially go for Class C exemptions is that they require less evidence to award (you don't need the official paperwork and often people don't provide it) and in many case the properties are dealt with within 6 months. Most will grant the Class Q or L if the docs are provided or it looks like it will be over 6 months before its sold on.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. Obviously the OP's Council was in the lesser category as proof was provided and not made use of!
Also, is Class L really appropriate when someone is BR? Surely the BR trumps all and Class Q should be used. When I joined, I needed a name. The forum members gave one to me...I am INAN

You beat me to it, that is my point exactly, i took everything with me and offered it to the lady i spoke to but she was not remotely interested:cool:
But i also know for a fact that at the time i was facing bankruptcy many here was much further down the line and facing these issues with the councils, 99% believed the council excemption band C was correct although a real pain and was paying the additional council tax, although at 50%, mine are obviously more greedy and want the full 100%
Have to agree again Ineedaname, i read class L and came to the same conclusion.0
