Could someone please sticky this thread as i know this comes up quite a lot and very few people are aware and many people are being robbed of £100's by their local councils!
Anyway onto the point of this topic.
Myself and hubby went bankrupt dec 2009, we have just had the possession order from the court for us to vacate our mortgaged propety later this month.
I went to my local council to report this and to get an excemption from council tax on the property from the day we moved out, 4th June 20011, i took along with me my OR's address as well as my bankruptcy orders and dischrge papers, the lady i saw said she didnt need any of it as she was just closing the account, i thought no more of it and didnt expect to hear anything regarding the coucil tax again.
Got a letter today from local council stating they have placed me in excemption band C: i.e Excempt from Council tax for upto 6 months due to property being unfurnished and vacant.
The letter went onto say after 6 months i would be responsible for 100% of council tax on the repossessed property:eek:
I was already aware of Band Q excemption from Council tax, but didnt know what it meant and where to get the relevant info to stick it down my local councils throat:rotfl:
So did a bit of research and this is what i came up with......
Here are the 2 important excemption bands and there meanings, you only need to be interested in band Q if you are declared bankrupt and are about to or have already vacated your mortgaged property.... Hopefully once i post this you will be able to click on the link in Excemption band Q which takes you directly to the correct form you need to fill in and return to your council, just print it out, alternatively do as i did and email your local council and have them explain why they have not applied the correct excemption in the first place, wait for all the excuses under the sun!:rotfl:
My email to council can be seen directly under this excemption list should anyone need help with what to email, just sent mine and am eagerly awaiting their long list of excusues for trying to scam me out of 100's if 1000's of pounds council tax for a property i am no longer liable for!:rotfl:
Full list of excemptions can be found here.....http://www.bristol.gov.uk/ccm/navigation/advice-and-benefits/council-tax/council-tax---exemptions/;jsessionid=209E838D2DE7283D4F65565639542B4F.tcwwwaplaws3

Hi There
I recieved a letter from you today regarding my council tax exemption. Council Tax Ref:***********
I have been placed into the Excempt class C: Empty and substantially unfurnished for upto 6 months.
This is the wrong excemption class as my husband and I was declared bankrupt in December 2009, therefore the correct excemption class is
class Q: The responsibility of a trustee of a bankrupt person Unoccupied properties where the person who is liable to pay the Council Tax is trustee for the bankrupt person (under the Bankruptcy Act 1914 or the Insolvency Act 1986).
Therefore i would appreciate it if you could send me the Council Tax Excemption Application- Bankruptcy Order or Administration Order form to me to fill
in and return to you so that i am put into the correct excemption class Q.
I would like to know why this was not done on the day i went into the council offices to show the member of staff my Court order to vacate the property
in view of the fact i clearly stated myself and my husband was declared bankrupt and when asked for an address i offered up my Official Recievers address and
it was declined and insisted upon that i needed to give an alternative address i could be reached at.
I trust this matter can be resolved quickly and the correct Excemption code applied.

This is very interesting but also very long with all the other exemptions listed. Perhaps an edit to show only Class C and Q and then a link to the list? It would be easier to read then.
But definitely worth a sticky if the mods agree. When I joined, I needed a name. The forum members gave one to me...I am INAN

Ok edited and reposted, please sticky this thread so everyone is aware of their rights as this seems to be a little known secret known only by the councils who are not willing to divulge it to you so they can continue to line their pockets with your hard earned cash!

I don't understand the problem, we moved out of property into a rental. We informed the Council we had moved to the new address and they did the rest for us. They put cat Q on the old house and jiggled the council tax as our rental was a higher tax band than the house we had left.
No problem at all.0 -
Thanks for that. We were told ours would be Cat C but after reading this I have printed the form, filled it in, and posted it.
Cheers!Building a new life after bankruptcy0 -

Its nice to know there are councils out there who are not trying this scam, but my own experience and many many others here have had the wrong exemption band quoted and the councils are fully aware they should be quoting band Q for bankrupts but are relying on the fact that people are not aware of this, my own OR didnt let me know, no one did, like many other things to do with bankruptcy you have to find out all the info yourself, i am so pleased you had a positive experience.0 -
Possibly not a new sticky but added to the Look Here First sticky within the first post.

Even if they did only put at Class C, it will have been repo'ed within the six months anyway, so you would not be liable.0

Not always Kepar, we have seen on this board that some repo's can take 9 months to a year or more.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0
