im not on this forum to discuss whether i am in arrears or not in arrears.I made the post to inform BCT customers that the consumer credit act has been broken by target and that if we have been charged then we are not liable to pay it0

The whole issue is the fact you're in arrears. Are you saying that you knew you were in arrears but did nothing about it and its BCT's fault for not telling you?? Surely not? If not then what exactly are you saying?

Am I completely mis-reading this (hope so).
Is OP suggesting you can default on payment and as soon as you get notified, the car is yours to keep?
No more fees/charges for any arrears whilst in non compliance i.e. not paying for your car.
So if you make no payments, they are not permitted to do...well...anything at all?0 -
(apples2) not suggesting that at all, think you are mis understanding, what I am saying is that during the period of non compliance (by BCT/Target) any interest or default sums charged are not enforceable.Also if your car was repo in this period then you may need to speak to a solicitor0

I think what targetloans is getting at, is that despite knowing they were in default, you cannot be charged any fees or interest until they inform you that you are in default.
So account in default 1st January, recieve letter 1st June, they shouldn't be charging between 1st Jan and 1st June.
Whether that is true or not, I think that is what TL is saying.0 -

fozmcfc, that is exactly what i am saying.BCT/Target have confirmed i went into arrears November 2010.When I asked when was my notice sent i was informed 27th may 2011.So this period where i incurred £1000 worth of charges/Interest i am not liable for.This is due to the non compliance of sections 9 and 10 of the consumer credit act by Target, not sending the notice back in november 2010. Confirmed with OFT, so a letter from solicitor will be on its way...0
