Hello all!
Long story short, a very old debt has caught up with me. Your looking at somewhere around the 6 year mark, maybe even more.
I was getting letters from Aktiv Kapital for months and just totally ignored them. The debt is for £4521.95 which is for an old Barclay account. They were offering me some sort of "NEW DEAL" incentive but i never got round to ringing them.:o
I have now recieved a letter from CCSCOLLECT saying they will reduce my bill if i have the courtesy to reply to it.:o
To be honest, i was just gonna ignore it, however they have somehow got hold of my brothers mobile phone number and have called him twice asking for me. No idea how they got that. He has told them we fell out YEARS ago and he will take THEM to court for harassment if they did not remove his number from their records.
So can anyone give me any advice on what to do next? Because they are calling my brother now i guess i'd better do something about it. By the way, the debt is in my old name and i've been married 6 years in July so thats how i know it is a OLD debt.
Thanks to anyone in advance if they can offer advice :T

You don't need to worry if the debt is over 6years old and you havn't acknowledged it in writing or made any payments for the past 6 years. This debt is statuate barred!
The DCA is allowed to pursue you for it if they want to but they cannot legally "force" you to give them the money. Not matter what they say it is all a pack of lies! They can't take your home they can't touch your wages etc etc.
Search for the "Statuate Barred" letter on Google and sent it to them. This should make them cease all contact with you...
If you can't be bothered to do this you can just ignore them and watch the letters pile up.
NEVER EVER PHONE THEM
IF YOU WRITE TO THEM DO NOT HAND SIGN THE LETTER JUST TYPE IT IN ITALICS.
These mugs have been known to copy signatures on to documnets.
Hope this helps :-)0 -

Sounds like they realised the debt was in the final throes of the six years wherein they could legally claw it back before it's statute barred, which explains the flurry of contact in recent months.
They were offering me some sort of "NEW DEAL" incentive but i never got round to ringing them.
Translation: Contact us NOW, before the six year limit runs out! Look, we'll even make it look like an unmissable deal in order to try and trick you into contacting us!
I have now recieved a letter from CCSCOLLECT saying they will reduce my bill if i have the courtesy to reply to it.
Translation: Look, reallyreallyREALLY contact us now, pleeeeease! Just a few weeks to go before this unmissable deal ends [STRIKE]and then we won't have a leg to stand on[/STRIKE].I was cut out to be rich, but got sewn up wrong.0 -
Thanks for the advice everyone. Should i send the letter now or wait a couple of months? If the 6 years in not up till next month (though i honestly i think it is already up) would my letter have any effect to the 6 year thingy?Slimming World Challenge 2017 0/30.5lb

Ohh, and i forgot to ask. Should i contact them asking who the bill is for and when it is off? Because that way i could find out it is defiantly 6 years isn't it? I would obviously send the £1 for the postage cost too.
Thanks in advance! :-)Slimming World Challenge 2017 0/30.5lb

ignore them, let them spend money writing letters, if it statute barred that's it. You could have a look at your credit report if its not on there, looks like its gone.More than Two Years in

I got exactly the same letter from the same company from 1996 for a barclays account saying I owe £446.
I called them and said I dont owe barclays anything - i still bank with them - and I have called barclays, they dont know anything about it - I have checked my credit report and their is nothing on it.
They said I could pay a reduced offer of 80% which I declined. They asked me to write in and state that I dont know about the debt, but I told them I am not going to because I know I dont owe any money.Personal Debt: £14,0000 -
I have only checked my eqifax report and it is not on there....could it be on my experian report?? I don't know if there are different things on different reports if that makes sense?? Lol xxSlimming World Challenge 2017 0/30.5lb
