Benefits - can the bank take them?

Hi, can anybody help, I read a thread somewhere on here but can't find it now that said banks were not allowed to use benfits payments to offset an O/D and they had to allow you the benefit money. From what I read there was a "law" or something like that which stated this. I've searched high and low but can't find the thread so any advice much appreciated.

  • i do remember seeing that thread, i have looked for it but cant find it,i'm prettu sure that the thread say they cannot take any benefits paid into the bank, sorry i cant help any more

  • Any moneys received from benefits can not be taken into account when calculating debt repayment plans.

    However, banks can and will deduct any available funds within an account to make payments (especially to themselves for "unlawful" charges)

    You can submit to the bank and “notice of appropriation” which directs them to only make specific payments from specific credits.

    If they breach this notice then you should report the offending bank to the FSA / FOS

  • Best plan is to move the money away from any bank you owe money to.
