Disputing debt to capquest

    Not sure about the address whatever is on the letters, be prepared for the usual response of we have asked for the information but you need to keep up with the payments. Thats c***.

    As soon as 12+2 days is up from posting you can then send letter in dispute and sit back and relax.

    Keep paying until 12+2 days are up, then send dispute letter if they don't send CCA, then stop paying.

    Posted off CCA today (14th June) by recorded delivery with postal order, do I wait 12+2days from today which would be 28th June ?

    Just an update on my CCA request to capquest, they sent me back a letter(dated 16th June) stating that my account is now "on hold for 28 days" and they are asking if I have any proof of payements or correspondence that would assit with my query and then asking me to forward these documents with a brief covering letter to the Collections Administration department so that they can resolve this matter as soon as possible.

    So what happens now, and reading between the lines does the above response reveal anything ?

    recieved a photo copy of the original credit agreement from skycard with my signature on it today from capquest along with a statement of how much I paid to date to capquest which is still about £1000 more than the original balance is this the end of the line? IT ALSO SAYS IN THE COVER LETTER THAT MY ACCOUNT REMAINS IN DEFAULT AND THE FULL BALANCE IS PAYABLE???

    Does the agreement have the correct info

    B Repayments
    A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following-
    (a) Number of repayments;
    (b) Amount of repayments;
    (c) Frequency and timing of repayments;
    (d) Dates of repayments;
    (e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.

    C Rate of interest
    A term stating the rate of interest to be applied to the credit issued under the agreement
    D Credit limit
    This may be a term or the manner in which it will be determined or that there is no credit limit.

    I think that capquest can charge interest but £1000 more than original sounds alot, what apr was the card?

    They have sent me CCA from June 2005, skycards t&c, copy of statements. It seems like and is titled as the original application form

    B Repayments

    (d) Dates of repayments; it shows the dates of repayments
    (e) The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.

    A term stating the rate of interest to be applied to the credit issued under the agreement the apr shows 11.9, 16.9, and 24.9 for standard purchases
    D Credit limit
    This may be a term or the manner in which it will be determined or that there is no credit limit.

    I am gutted to say the least as I have repaid nearly £700 to date with nearly £1200 outstanding on an original opening balance from them of just over £1300, this has got to be wrong, it seems they have license to charge what they like, its disproportionate to say the least, I wouldn't mind I hate these b*****ds out of all the DCA'S, they are parasites, so is there anyway forward or have they got me by the b*****ks now

    When did you last pay any money on this account?

    Also an application form may not be a CCA.

    What we need to understand is what you are supposed to have bought with this.

    Was this a loan for one item or a "store card" allowing you to buy from them or credit card? Because what you have written in bold make no sense at all in terms of determining if this is a valid CCA.
