If cards have been used fraudulently, I presume that you have involved the police.
A request for the information you require, would possibly carry more weight, if it came from the police.

  • Thank you all for the info, I figured it would incur a cost. If for some reason they continue to refuse to give out the information, even with paying the fee and giving them the "28" days, what would be my next step? This hasn't happened yet but I'd like to plan ahead. I can not stand being held up, which is exactly what this is doing, if it were the other way round, I'd probably have recieved several charges and threatening letters

In regards to the mention of fraud, I'm not going into that, it's a 3 year+ very complicated issue involving 3, potentially 4 major companies, not just Barclays. I did post the details somewhat In my first post here? This is just to address an issue within a multitude of issues.

    Again, thanks for your help.

In regards to that, I'm arranging a free hour consultation with a local solicitor.
  • Unfortunately any data requests that do not fall within the provisions of S.7 of the DPA (which is 40 days not 28 as suggested) have no statutory time limit, other than the period should be "reasonable", if the data controller refuses to co-operate then you would need to submit a formal compliant to the Information Commissioners Office.

 It’s hard enough remembering my opinions - without remembering my reasons for them
