We're back to court tomorrow...wish us luck.

Further to my posts about my friend, Cath, her CCJ and her application to set aside.

The date for the hearing has been changed to tomorrow at 10am from 19th Dec.

The solicitors acting for Open University never sent her their case statement, we sent a special delivery letter to them after the first court hearing which was adjourned asking for their case statement, we asked for it to be sent to me as well as being sent to her, (as she has now got a morning job and she wouldn't be in to sign for it if they sent something by recorded delivery and she wanted to ensure one of us got it).

Anyway...it got there, we had online confirmation and we got a photocopy of the paper copy of the signature.

They STILL haven't sent their case statement for her to see, which the District Judge said they had to send her for her to see.

The hearing is listed for another district judge now, which is a pain as he may not be familiar with the previous set aside where the DJ said she couldn't listen to any evidence as Cath had not had the other side's case.

So...not sure what will happen...she's rung a company that does IVA's as payplan weren't very helpful.

    You say it is another judge, but don't worry asthe judge WILL look at all evidence and will listen to your friend's defence.
    Did you/she get to speak to a solicitor?
    I am a bit confused as to why she has rung a company that specialises in IVA's.

  • She was told by PayPlan that her other creditors weren't 'PayPlan' friendly, actually they were terrible!
    Having looked at her debt, she feels that she would prefer an IVA, she has very little in the the way of a credit rating and she just wants an end date and Payplan said they thought she could consider an IVA.

    I think she is just getting all the info available.

    The solicitor she spoke to and had an appointment had to cancel, he was ill and she couldn't get into see anyone else so we're going 'blind' if you like again..unfortunately.

    I am sure that she is getting good information, but BEFORE she commits herself to an IVA, try and get her to post her SOA here, and let a few of us share our experience and advice. It won't cost her anything.
    Most important thing for the moment is to get tomorrow's hearing over with.

    We bought her a cheap PC and she's on dial up, she's regsitered but I haven't seen her post yet!. Will get a copy of her SOA tomorrow and either she or I will post it.
