Company sick pay.

Hi all,not been on for a while-just got a query on company sick pay,even though my contract states i am entitiled to 2 weeks p/a full sick pay based on my service length it also states that this is a guideline and full pay is down to management discretion,i ask this coz ive recently been off work sick and know that they will try to get away with not paying me,is this legal? i cant afford to lose three days pay just before chrimbo and was just unsure of my rights as an employee-i cant remember the last time i was off ill. any help very welcome and appreciated.

  • My understanding of this is that your employer is not obligided to pay you anything but Statutory Sick Pay (very low) after a certain period of time. In this day and age that disgusting.

    oh well,im gonna complain tho,if there not gonna pay me i want a reason why!
  • Depending on the terms and conditions of your contract, they have every right to withold pay, but normally under certain circumstances.

    In my company's case, it was if we had reason to believe that the employee wasn't genuinely sick (hard to prove), or if we gave 30 days notice that we were withdrawing them from the scheme.

    On a side note, we withdrew them all from the scheme about a month and a half ago. It may sound harsh, however the spiralling rate of sickness was putting pressure on those employees who haven't pulled a sickie in years.

    As an addendum, forgot to mention above that we do still actually pay company sick pay, but after 3 days of illness, in order to cut down on "24 hour" bugs.
