    I never signed a contract, in fact neither has my firm, as it would be paid by cheque by my firm by invoice.

    I just feel hard done by by it all, as if I hadnt brought it to their attention again and kept my mouth shut I probably could have got away with it indefinately. They are just useless and unhelpful about the entire thing and think I should just fork out the £406 today and be done with.

    mmm, if you haven't signed a contract then I would suggest that they don't actually have a leg to stand on. Wouldn't this be treated the same as a credit agreement? If they can't produce evidence that you signed up then they cannot legally chase you for it?

  • after a little "conversation" with them, they are going to start my gym membership from 1st Dec.
    HORRAH! They were all very stubborn and unhelpful about it. I think when I mentioned I never signed any contract with them they backed down rather rapidly!!!

    Thank goodness!

    I think they realised that they wouldn't legally be able to make you pay. And 6 months free membership- yey!

    I must admit now, the same thing happened to me for a year, I had a joint membership with my sister, all coming out of her account, I paid my subs into her account each month and she didn't realise they were not taking the DD. Anyway, they challenged me about it one day and since none of the paperwork was in my name I asked them for copies (I was totally unaware the DD wasn't being paid). They couldn't produce anything at all, apologised and asked if my sister would come in with her bank details again. We were not charged the back dated amount.
    Saving for an early retirement!
