Hiya
Is there a different procedure up here? I've heard a rumour that it's only 5 years worth that can be claimed, and that there's a different process. However I've read through Martin's brilliant advice and can't see anything about this.
Has anyone reclaimed in Scotland that can let me know if they did it using Martin's method or a different one.
Thanks to all in advance

HI Smog, I have completed two claims against BOS amd am about to start on 3rd.
The procedure is rhe same to start off with, you get hold of all your statements usind a DPA (Data Protection Act) request if you have not kept them. You can use the same template letters to send your preliminary request and then later your LBA (Letter Before Action) If you have not had a result by this point here is where it differs, in Scotland you can only claim upto £750 small claims or £1500 Summary Cause.
I did go back 6 years on my first claim which was before it became clear that the statute of limitations in Scotland is 5 years, but it was never queried at any point (your claim from is checked over by a sherriffs clerk for any glaring faults and they never mentioned it ).
I joined CAG here https://www.consumeractiongroup.co.uk and also read around the Govan Law Centre site here https://www.govanlc.com.
Apologies for any typos my glasses have broken in half and the sellotape isnt working !0 -

Hi Smog
You can also claim in England if your bank has an address in england. This gets round the £750 limit and the 5 year rule.
I claimed through Moneyclaim on line and used a friend's address in England. Very straightforward
Loads of help and support on CAG and here
Good luck!0
