Creation Finance Owe Me Money, Not The Other Way Around! Help!
Hey, I was wondering if any of you guys could offer me some advice on a problem I've had with Creation Finance for over a year now.
Last April I tried to order a Dell laptop (~£800) on dell.co.uk in my name (Ryan McDonnell) but the site was bringing up errors in the finance section and the order would not complete.
The next day I ordered the same laptop in my fathers name (the idea was to BACS him each month) and the order completed.
That day I also received emails from Creation Finance, the providers of finance to Dell customers, confirming that I ordered 4 identical laptops and that finance was accepted. I checked the Dell site and only one order was there in my name, so I rang them to cancel the order and this was done, I still have the email.
I also phoned Creation Finance and told them that there should be no finance in my name and that any order was made in error by the site, this was accepted by the man on the phone, and in the meantime, I received the laptop ordered in my fathers name and began payments.
Then one day in May 2010 when I was at work, Creation Finance phoned my house asking my father if 'Ryan McDonnell had received his laptop'. Unfortunately, thinking that they meant the laptop I received in his name, he said yes.
They then started taking £30 out monthly (in addition to the £30 I was sending to my father), so I phoned Creation and the women accepted that this was an error and the account would be cancelled, and my money refunded.
This did not happen and a total of £90 was taken from me until I decided to cancel my direct debit with them in September 2010, which has caused more problems. On the numerous times I have contacted them they insist that I must contact Dell, who will then contact Creation and confirm that no order exists. I have done this and yet Creation insist they have nothing from Dell.
It's so frustrating because it's their word against mine and they're now threatening me with debt collectors.
I was wondering what I should do, I intend to contact Dell tomorrow and insist they email Creation regarding the matter and forward it to me if possible.
How can they base a finance agreement on a phone call to my house? They clearly had no confirmation from Dell that a laptop in my name was shipped, and stupidly they didn't even confirm this with me! A burglar could have said I received a laptop!

I had mega problems with Creation Finance. When they tell you something over the phone they never, NEVER do as they say they will do. Their so called consultants are very often aggressive, even more so when they have made a mistake. They will tell you more or less anything then do absolutely nothing.
I would suggest you make a complaint in writing and sent recorded to both Dell and Creation Finance making sure that Dell send a written confirmation to you within 7 days that they have confirmed with Creation that your agreement was either never actioned or that it has been cancelled. Creation will tell you that you must wait initially 4 weeks then if the problem hasn't been resolved you should receive a letter telling you to wait yet another 4 weeks after which you can report the whole lot to the Financial Ombudsman Service. On the plus side even after the wait you should get your refund and maybe even some compensation for inefficiency particularly from Creation.
If you feel that Creation have harassed you in any way then there is a Code of Guidance from the Office of Fair Trading and there is also Section 40 of the Administration of Justice Act which deals with harassment and may help you speed things up a little. Worth a read anyway.0 -
its not all about compensation, but yes they should refund and correct your credit fileDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

I quite agree it isn't all about compensation but Creation Finance consider that whatever they do is right and the client has no rights whatsoever. To get them to refund and to correct mistakes is a major task and if it takes Ombudsman intervention and compensation then so be it. After all, those of us who have had problems with Creation know only too well the stress it causes with the continual broken promises, the feeling of banging one's head against a brick wall etc., then if they have to finally admit they are at fault by paying compensation surely at some point someone may just realise that they can make mistakes just like any of us.
Not a pleasant experience to have to deal with when there's a problem with this company.0
