Charging Order for Tenants in Common

My partner and I are 'Tenants in Common' . Due to my partner's debt a Charging Order for over 13K has been applied for against our property. I am really worried about this and am not sure if my equity in the property will be protected from the Charging Order.

I would apreciate any advice, thanks

It could ultimately force a sale, but you would receive 'your share' after any mortgage (1st charge) and/or established 2nd charges settled but before funds were released to partner/charging order settlement.

You need to financially disassociate yourself for a whole number of reasons if possible.

You would probably be best advised to take professional legal advice on the whole position at this stage.

Thanks for the advice. I would very much like to to financially disassociate myself from my partner - he has a lot of debts and has done for many years but only wants to discuss this when it suits him, ie. when he wanted to re-mortgage to pay off his debts.I bitterly regret agreeing to this.
My main problem would be having to find somewhere else to live but hopefully I'll acheive this one day when my children are older and I've saved some money.
