On the fly tipping, Did someone actually take your name and address and were you daft enough to give them it ?
Or did they just post one out ? If so that can be overturned within the minute .
I received a fixed penalty notice in the post along with photographic evidence of both the (single) bag of waste rubbish and a letter from within the bag that had my name and address on it.0 -
The vast majority of the posters on this Board fall into the can't pay category.
Very few posters are won't pay.

In terms of none payment for Housing benefit they would of At least wrote to you 3 times before Closing your claim and Logged all letters sent to you and any that may of been returned as undelivered .
This didn't happen and I would challenge them to provide the proof if they claim it did. This is why I have got so stubborn about it all. If they did inform me, then why would I NOT reply? It would literally have been a case of ticking a box on a form, signing my name and sticking it back in the post.0 -
Have you ever done a Subject access Request? This would require them to produce all the documents that were sent to you.If you've have not made a mistake, you've made nothing0

The decision of the magistrate is made on the basis of culpable negelect or willful refusal - in your case its more likely the would consider the culpable negelect side as your ignored the council.
You can be committed for a period of no more than 3 months after which the amount is not automatically written off but the council cannot use enforcement to collect it at that stage. If you are sentenced and pay part of the arrears the court will remit an equivalent proportion of the sentence.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
