Under the rules of discloser if it is not put out and then relied on as evidence it can and will I suspect be struck out. As I said be careful and play by the rules of the Court and not like the CSA and make it up as they go along! The Court won't like it!0

Maria Miller: The Department for Work and Pensions regularly reviews its research requirements. Specific research proposals are considered under a range of criteria, including evidence priorities and value for money.
The Green Paper 'Strengthening families, promoting parental responsibility: the future of child maintenance' has set out the coalition Government's vision for child maintenance. The research required to support these proposed policies will be considered against the wider departmental requirements.
Currently more than three million children live in separated families and around 50% do not receive child maintenance.*SIGH*

I would guess it is 85% compliance of the cases that are open through the CSA, and 50% compliance out of all households including those who aren't through the CSA, perhaps..?0 -

this is where stats can get twisted, I do not get CS however we have a shared care arrangement nearly 50% each and he also buys or goes halves on clothes, school trips etc so whilst it is shocking that 50% of children do not receive CS - is this the true picture, also how many children don't have contact with the NRP as I find that shocking the either a parent walks away or is stopped from having contact0

Have just been told that the solicitors for my other half will be going for compensation, don't know how much it will be but could be enough to pay off the total arrears as well as leaving a 5 figure sum left for us!
If the Judge awards this as damages to an NRPP just watch the claims go in, it will blow the flood gates open on a system that is run by idiots and has lost its way as to what it should be doing! It could cost £Ms. Thank you CSA!!! That is from me as a tax payer as it is us that will have to pay for these people that don't know or care what problems they leave in their wake so freely!0 -

Blob I'm very interested in this as our case was/is very similar to yours except did not quite go as far as yours.
We were under impression that with CSA compensation was not claimable, yet financial redress - on their assessment only, yet as we have also major data protection breaches, ICO advised us to takeCSA to Court for the huge breaches in DP LAW in our case, we hae forms yet as yet have not submitted them as thought we were on a loser!! Although their loss of our bank statements to include losing NRPP bank statements/wage slips/child benefit details etc was proven by ICO
I'm interested as to what legal grounds/approach your good lady's solicitors will be taking as this is something we could probably also collaborate and do same

She had to sue me to get the money that she had put into the house when we got it protected, the CSA were made aware of this action and ignored it, it is in the notes that one of them made at a meeting that was attended by my MP, so the Judge was not interested in their bleating that they did not know of the case. They were very lucky that he did not arrange 'Bed and Breakfast' for them at the expense of the State at that point!
During the time that this case has run, my other half has been under the Doctor for 'Reactive Depression and was found to be suicidal' All of the medical notes are in the file before the Court, and the medical opinion is that the CSA are responsible for this, the compensation calculation will be based on her Death in Service payment from her employer, so it is all in black and white. There are still times now that she is very bad and I expect a call from her work to inform me of all sorts.
You have to remember that they lost all Crown Immunity not that long ago, so that they are now open to the full force of the law when they make a mess and the effects that this has on people. It will come back to haunt them, the CSA officer that was in Court was totally destroyed by the Judgment handed down and the instructions of the Court on the matter of repayment of the arrears. He should not worry too much as if the Judge carries on in the same vain then all the arrears will be cleared by the damages that the CSA have to pay, it will be in excess of £60K by my calculations. It is however a very dangerous thing to pre-judge what a Judge will say, as the CSA found out!

Ok...................so they lost Crown Immunity!!!!!!!!!!
I suppose that is where ICO are telling us to take them to Court, as we had previously been informed it was not possible to take CSA to Court.
Ok I will complete paperwork and indeed will take CSA to Court on advice of ICO
