    If the paperwork went to an old address then to get a judgement set aside you would need to prove that the debtor had been informed of your new address. If you didn't update them with the new address then that won't normally be grounds to get a judgement set aside.

    I think my paypal one was updated but not my ebay one i was going through a bad divorce so things didnt seem important at the time do you have any suggestions of what to do?

    Apples' strategy sounds like a good plan, pay it off and then see if you can get set aside. Difficult to predict exactly which way a judge will go but probably worth trying if you want to get a mortgage.

    Yeah but apples strategy he they didnt contact him and i didnt let them know i had moved.

    Maybe but there were communication options available. He could have contacted you through Ebay, Paypal (if you can, don't know), during the ebay dispute you may have seen each others personal email addresses.

    Your dispute was dealt with at the time by the people empowered to resolve the dispute (Paypal) and they decided in your favour. You had no reason to consider there were to be further challenges to that decision.

    IIRC one of the very first questions the Judge asked me is if I had paid the money as soon as I became aware of it - which I did.

    Your focus is the CCJ, not the money for a few toners so get that out of the way although I think there is an option for challenging the whole thing as it had been formally dealt with iaw the ebay "contract".

    If you haven't been before, it is very infomal, just got ushered into an Office. Me, my legal council, the judge and a woman recording events.
    5 minute chat to explain to the judge and he simply turned to the woman and instructed the CCJ to be Set Aside.

    So quick was it I did actually say, "Is that it?", the Judge replied, "Yes, it will be removed from your credit file today".

    Thank you so much for the sound advise :beer: could you look at my post and see if i need to change any of the evidence or the why, also do i have to contact the idiot that took me to court to pay him? i will pay it tomorrow i have to let the house i found go, thank you again

    You will have to pay him somehow.

    As for the content, I wouldn't like to be drawn into someone elses case.
    I will say though that you should keep it factual and as short as possible whilst getting your point across.

    No rambling paragraphs.
    In your opening post between lines 3-4 I started getting confused, sentence is too long (or whole paragraph).

    Bullet point it if it helps.

    The clearer and simpler it is to read, the more likely the judge will digest the info and have a clear picture of events.

    A bit like posts on here where people use Txt speak, I simply cannot be done with it so switch off almost immediately. I can't take the posts seriously.

    Short, simple, factual. No ranting, no opinions, just the facts to remove the CCJ (toners don't even need mentioning).

    Yep, stay short, concise and on subject.

    If you rant and drivel like a complete loony, expect those toners to hang round you neck like a millstone.
