CCJ advice

I had a minor bump in my company car in 2008, my companies insurance were handling to claim really slowly, and for some reason i got a court summons through in my name for the accident.

I spoke to the insurers, forwarded all the paperwork i'd been sent and left them too it - as I wasn't responsible for settling the claims etc and left them to it (i asked him at the time if this would affect my record and he said no!)

anyway we went to get a loan from the bank so we could clear off and cut up our credit cards and we were declined due to a ccj on my record. This turned out to be a CCJ in my name as a result of the above claim.

Thankfully i still work for the same company so i chased it up, they are looking into it for me.

but is there anything i can do? will this removed the CCJ from my record it they can prove it was paid? or incorrectly put in my name!

i'm really worried this will screw things up for us :(

    Yes it can be removed.

    Pursue the insurer to sort this out (their legal team will know how to get the ccj "set aside", and there is some cost involved, but it is all down to them to resolve).

    Once they have applied to the court, and got your ccj set aside it will be as if it never happened, though the procedure will take a little time.

    I've nosied on Experian a little more and the insurers have to do the leg work on it. Just hope it doesn't take too long!!

    this happened to me 2 years ago! I was livid.

    I would recommend following the procedure of calling the insurance company, calling the courts etc.


    My insurance company (who were responsible for the debt) had to write and send a cheque for £75 to the court stating that it was indeed they who were responsible for the debt. - So CCJ removed by court.
    secondly, the insurance company had to write to each credit agency (experian, equifax and call credit) who them removed the CCJ. All this was the advice of creditexpert and my creit and score on all 3 sites now show in the excellent category.

    THe FSO has adjudged the insurance company to be at fault and although after much leg work I had it removed, and the insurance company paid me compensation of £1000 - Result

    take it to FSO as well.
  • I tried the FSO route but i recently found out it was the third party insurers that didn't confirm to the courts that the debt had been paid so they won't represent me.
