    Just wait till he leaves then report them to the min wage office.
    Part of HMRC and thay don't like employers that do this.

    Keep acurate records of hours worked, especialy if they try to get him to work overtime for no money, rosters and payslip are a good start.
    Also a list of other people that are effected even if they have left.

    Should get the back pay if HMRC investigate

    If it's a 40 hour week then it's a 40 hour week, not a 35 hour week. That's 8 working hours a day, not 7...

    It depends how they've worded the contract, it could be either.

    Sadly you will find the crap minimum wage levels is what screws young people. At 21 I can remember working a wage that was the same as the dole by the time you figured in additional benefits. It was hardly an incentive and I quit after 2 weeks - Tory Britian.


    When I was an apprentice in 1980 I was on 89p per hour lol

    Sounds dodgy. If its 40 hours a week working (eg. not 35+ 5 lunch) then thats even lower than the min wage for 16 year olds.

    Don't put up with it. Make them break it down and state what the equivalent hourly wage is and how many hours they expect him to do. If its less than min wage then respectfully say that isn't acceptable and they need to give him at least minimum wage.

    Also they should not be trying to avoid him paying tax - if they are doing that I do wonder if they are even planning to show him as an employee at all!

    sounds to me like they are paying for a 16 yr old to work 37.5 hrs with 5x 1/2 lunch's making it up to 40hrs

    he's still awaiting them to get something in writing. he has just turned 20 so i assume he should be receiving £4.92 mw. the company has not long started up and i believe they are trying to retain as much money as possible and wage is obviously one of them.
    he is not and apprentice more a trainee, i should find out more from him this week, i may just report the company, but i'll see what his wag slip says when he gets it
