cap quest on my credit report file

hi i am new too this site and im looking for some advice,sorry if im posting in the wrong place.I had a catologue with littlewoods and i never signed a credit agreement, so i asked for a signed copy of the agreement which never came, then i found out that they had sold the debt too Capquest,ive recently applied for a mortgage and been turned down because of this Capquest on my credit file, what i really want too know is can this firm really put it as de-faulted even though the account is in dispute,because i never signed any credit agreement?

If your only dispute is that they have not provided you with a signed copy of the credit agreement then yes they can file a default on your credit file.
The debt could be legally unenforcable until such time as the produce a credit agreement but they can still continue to report to the credit reference agencies in the meantime.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
is there anyway i can remove it from my credit file because i know they are never going too come up with the signed copy, or will it just stay on my file? thanks0

It will stay on file for 6years from the date of default.
If you pay the debt off it will be shown as a satisfied default for the remainder of the 6years.
It is possible to get mortgages with satisfied defaults on file, although these likely won't be the most competitive deals on the market but more the sub-prime end of the market.
