I have a loan I've been paying for a couple of years and when I recently checked my credit report there is no entry for this loan. When I checked the loan paperwork I discovered that they have the wrong date of birth for me.I know this seems wrong but I'm quite tempted to try my luck and cancel the direct debit and refuse to pay with it not being on my file.

You owe the money. Pay it.

I don't imagine it would be too long before a nice CCJ appeared on your credit file should you decide to just stop paying. I assume you weren't hoping to apply for any credit in the next 6 years or so?

Even though it doesn't exist on my credit file?

Minor typos or mistakes like wrong date of birth do not invalidate credit agreements. The fact that it is not on your credit file is irrelevant to the fact that you owe the money, and in a county court you would be guaranteed to lose.
I used to think that good grammar is important, but now I know that good wine is importanter.

I'll give you the benefit of the doubt (that you're not trolling) and say that you have more than one credit file. Perhaps you didn't know?

I am no expert but I am not aware of a time-limit for the lender to note the loan on her credit file, and stopping of payment may well be the motivation they need to update said credit file (whichever version they use).

I'm not an expert on these matters but wouldn't the fact that the OP has been happily paying the loan up til now make it difficult for him/her to de-claim responsibility for it now?

    Yep.

They might also want to explain to the lender why they didn't check the agreement and notify them of the incorrect DOB before signing it (not that this makes the slightest bit of difference regarding their responsibility for paying back the loan).

And the CCJ would trash your credit rating so you wouldn't get a loan to pay the court costs. :D
