I am currently on a DMP with CCCS. One of my debts has been handed off to a DCA and their is a dispute in relation to the outstanding balance that is on the statement and the one that the DCA state in their letter. I haqve wrote to both Moorcroft and NEXT. Next are ignoring my letters and Moorcroft inform me that the account is on hold until the investigate the matter that was some 3 weeks or so ago.
My question
If I write to NEXT and request a SAR. They have 40 days to respond if they do not respond is the debt enforceable?
If they do respond but fail to provide the original signed CCA and other documents bearing in mind the credit agreement was taken out prior to 2005 then again is the debt enforceable?
Any help is much appreciated.

Failure to comply with a SAR won't render the debt unenforceable.
Failure to comply with a CCA request would do that in some circumstances.
However, if the debt is disputed, then while that dispute remains unresolved the debt collector should not try to collect the debt. Trying to collect a disputed debt would be against OFT guidelines.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
